<p>And, &#8220;Why do the rulings more often than not favor his side?&#8221; If you have asked yourself either of these questions, then read on because this article is for you.</p>
<p>Divorce War as Legalized Domestic Violence</p>
<p>When the public looks in on a case and declares domestic abuse indeed exists, then what usually happens is that the micro-dynamics quickly shift. The battlefield fills with foreign soldiers as the sticks and stones in your backyard are replaced by judges, attorneys and guardian ad litem &#8220;for&#8221; the minor children.</p>
<p>Now, at first you think these folks are in place to &#8220;help&#8221; you protect your children. And deep in your soul you long to see these so-called helpers break the cycle of family violence that abounds.</p>
<p>But what you observe is not quite as you expected. Instead, you find yourself thinking and feeling the same set of emotions that filled your day in your home before your divorce proceedings.</p>
<p>This roller coaster of fear, anxiety and hope that you ride is your new nightmare. The only difference is the weapons of destruction have changed.</p>
<p>What Fuels Domestic Violence Transformed into Legal Abuse?</p>
<p>Abuse is about control and so is litigation. And unfortunately for you, abusers thrive in this arena. You witness your partner appearing to &#8220;enjoy&#8221; seeing you buckle while tormented with his endless legal stalking.</p>
<p>And you wonder how is it that the &#8220;helpers&#8221; are helping him carry out his campaign to wear you out and ultimately break you down. You fear the realization of his threats&#8230;to leave you childless, homeless and penniless.</p>
<p>Then you wonder, &#8220;What is driving this litigation? Who are the perpetrators? Is it your soon-to-be ex, his counsel or even worse is it the court appointed agents? Could it be the Judge?&#8221; you ask yourself.</p>
<p>Understanding the Larger Politics in Domestic Violence Divorce</p>
<p>Let&#8217;s pretend for a moment that any of the questions posed in this article have crossed your mind. <p>Domestic violence is unfortunately very prevalent in the state of Florida.  It has been defined in the FL Statute 741.28 that &#8220;any assault, battery, sexual assault, or any criminal offense resulting in physical injury or death of one family or household member by another who is or was residing in the same single dwelling unit&#8221;.</p>
<p>You can also further divide domestic violence into three main categories.</p>
<p>1.Physical abuse,this would obviously be a physical assault such as pushing, slapping, kicking, choking, and beating.</p>
<p>2.Verbal Abuse would be intimidating conversations followed by acting with anger and stalking.</p>
<p>3.Sexual abuse is as it sounds, unwanted sexual touching or forced sexual acts upon someone.</p>
<p>So if one or more of these domestic abuses occur, and occur by persons who meet criteria as stated in statute 741.28, then what can you do as the victim of such awful crimes?</p>
<p>Well, the most effective short term solution is petitioning for a domestic violence injunction on the assaulter. Most Police and Sheriffs offices have a Domestic Violence Office and would assist in the filing of an injunction.</p>
<p>An injunction, if you choose to file one, would in effect be a court order that demands the offender to stop doing an action to the other party. This is done in order to protect further damage to the victim of the actions that take place.</p>
<p>Domestic violence is often a repeated offense and usually will not stop until the necessary action has taken place against the aggressor. <p>Victims of domestic abuse reach out to the system for help in stopping the abuse perpetrated upon them. This can involve both healthcare and law enforcement. Yet, what actually happens, more often than most people know, is that these so-called &#8220;helpers&#8221; can be used to perpetuate domestic violence &#8220;legally&#8221; during divorce.</p>
<p>In healthcare, it&#8217;s the psychologists and psychiatrists. These healthcare providers are frequently manipulated by abusers to aid them in establishing false claims about the domestic abuse survivors that they batter and control.</p>
<p>Psychiatric Diagnosis as Batterer&#8217;s Club in Domestic Violence Divorce</p>
<p>Almost daily, I am sought out by a domestic violence survivor seeking help from being falsely accused of being mentally ill. In many of the cases, the mental healthcare diagnostics appear to be grossly improper.</p>
<p>But that doesn&#8217;t prevent a court from making determinations about the accused. In many of these cases, the battered mothers (and abused fathers) are faced with losing custody of and, in some cases, even the essential moments of simple human contact with their children.</p>
<p>Once judicial decisions are made, remedies can be added on and on, with no regard for the accuracy of the original foundation underlying the initial judicial decision. We have seen domestic violence victims prevented from having unsupervised or any access to their abused children because of a clinical psychiatric diagnosis.</p>
<p>The sad thing here is that those directly negatively impacted, like the protective parent and children, are unaware of this ploy during its set-up and ultimate execution. Often they go along with certain procedures trusting in their sanity and hoping for justice to prevail. Then, the day comes when they awaken to the fact that they have been re-victimized by their abuser&#8217;s manipulation of the psychologists and psychiatrists.</p>
<p>Psychiatric Re-victimization To What End</p>
<p>Now you&#8217;d think that if the batterer is getting a divorce and seeking to move on with their lives, then the victim&#8217;s declared mental health status would be of no interest to him/her. Wrong&#8230;completely wrong!</p>
<p>By establishing for &#8220;the record&#8221; that the domestic violence survivor is &#8220;crazy,&#8221; the abuser leverages their ability to regain and maintain control over the family&#8230;and most importantly, control over themselves, or at least control over their public image. Many people will tell you that the legal psychiatrics of a case are nothing more than to save face for the batterer.</p>
<p>The abuser seeks to walk away looking good and certainly not being an abuser. To this end, they must make the victim to be &#8220;bad&#8221;&#8230;&#8221;wrong&#8221;&#8230;&#8221;crazy.&#8221; Essentially, the abuser enlists (directly or indirectly) the healthcare provider to discredit the victim in order to invalidate who she/he is and what she/he stands for with respect to being a domestic abuse survivor.</p>
<p>If you are a domestic violence survivor and have been threatened with losing custody of your children and the credibility of you mental health status, seek to understand how batterers manipulate healthcare providers to establish false claims. And as you learn about the reality of what&#8217;s before you, find a credible professional to help you prevent this life-changing destructive legal psychiatric ploy. The sooner you become proactive in preventing the establishment of false claims, the easier you can prevent them from defining your life and limiting your liberties.</p>
